Eden Township Hearing On St. Rose Merger, Sutter Health Lawsuit

On becoming a district hospital, St. Rose Hospital becomes eligible for such government subsidies as federal matching funds for inter-governmental transfers, and access to parcel tax revenues, with the approval of voters.

The lawsuit states two Sutter Health officials involved in the decision to transform the hospital have financial interests in Sutter Health and that constitutes a conflict of interest. They say the health care company's plan should be invalidated.

Former San Leandro Mayor Tony Santos told Patch in a comment that he doubts the District can merge with St. Rose until litigation resolved.

Santos noted that an arbitrator has ruled that Sutter owns San Leandro Hospital and told the district to turn over title to Sutter. All of this has been put on hold pending the final resolution of the District's suit against Sutter, Santos added.

The district has lost both in Superior Court and at the Court of Appeals. The District has appealed to the Supreme Court which has sixty days from January 31, to decide if it will hear matter, Santos said.

All of this means further delay and uncertainty.

The hearing begins at 6 p.m. at the (13909 East 14th St.).
