Man Gets Gets 52 Years For Attempted Murder In San Leandro

      A 22-year-old man has been sentenced to 51 years and 8 months in state prison for shooting into an apartment in San Leandro last September where his girlfriend and her young son were living.

Bobbie Lee Smith was convicted of attempted murder with the personal and intentional discharge of a gun, assault with a firearm, shooting at an inhabited dwelling and child abuse for the Sept. 15 incident.

Prosecutors said Smith's girlfriend, Krystal Love, broke up with him over the telephone at 8:45 p.m. that night and he threatened to come to her apartment and harm her.

They said about 45 minutes later, Smith banged on Love's door and directed her to open it.

Love then ran into her bedroom, grabbed her son and called police, according to prosecutors.

Smith then fired six shots into the apartment, five of which went through the front door around the peephole, prosecutors said.

One of the bullets traveled into the bedroom where Love's son had been sleeping, they said.

Smith was arrested on Sept. 28 at 9303 Stearns Ave. near Bishop O'Dowd High School in Oakland after an hour-long foot chase and a standoff with police.

Oakland police set up a perimeter in the area and imposed a lockdown at Bishop O'Dowd as well as at the nearby Barack Obama Academy.

Prosecutors said that while Smith was in jail, he made numerous phone calls to ask his brother to hide the firearm that he used to shoot into Love's apartment.

Smith was sentenced by Alameda County Superior Court Judge Kevin Murphy at a hearing on Wednesday.
